Level 21 Rogue tanking SFK?

Ok, I am wondering why we were unable to kick the tank. He was a warrior, had no spec and white/green gear. Yes we were only in SFK, but had no tank. I tanked on my rogue in BOA gear. It was kind of fun, but the dungeon took forever and then we could not beat

which sucked that we spent all of that time for nothing. HAs anyone else had this problem to where no one can kick someone?

What was the message you received when you tried to kick him?
Oftentimes, low-level dungeons pull constantly, so you always get the "Cannot be kicked during or shortly after combat" message. Or, you may have used too many vote-kicks in a short duration that you were no longer able to initiate votes, etc. There's a limit to how many you can do, and sometimes it'll extend the amount of time before you can kick a character depending on how kick-happy you've been. (ie: I've heard of people seeing "Player cannot be kicked for another 4 hours" before, etc.)

The UI usually tells you why you can't kick someone. If the group just formed up, I think you have to wait a bit before kicking someone. If you all stayed in combat for most of the time, you wouldn't have been able to kick him. There was no message as to why you couldn't kick him?
It's hard to believe that people can't pick up on things like picking a specialization nowadays, with all of the pop-ups when you level and get a new feature or ability.

Yes we tried talking to him, and he did nothing. I cannot remember the exact text that came up. I think it was something about not being able to initiate or something like that. We already downed one boss and the tank went afk, we kicked him and got a new tank. The new tank pulled a slew of monsters and left party before he died. We all dies, queued and got this tank. No one in the party could kick him. We all got the same message. We even gave the otehr people group leader thinking that that may help, but nothing.

You get a lot of this until you hit level 23 or so. It is mainly trial people just being idiots.
The amount of truly aweful players and ninjas drops considerably after you get past dungeons that the trial accounts can queue for.

Sounds to me like you may have been on a kick 'cooldown' because of the initial kick. Depends how long it had been since the first kick you performed. Also, if I recall correctly, the kick mechanic isn't specific to one dungeon, the ability to kick may have been reduced due to kicks occurring in previous dungeons as well. The only real way we could answer this is if you could tell us exactly what the UI was stating when a kick was attempted.
Also, can I assume this is Live and not Beta? If this is beta could be something entirely different.
