Waylay procs only from ambush criticals,and you dont have 100% crit chance with ambush...you have very high chance but still not 100%.
Also i warmly suggest taking Honor among thieves,also filthy tricks arent that mandatory.
Spec is worth trying but it will be needing some tweaking.
Just to clarify, since the OP is basing this build around the upcoming rogue changes, he's probably also basing his poisons around the following new change:
Waylay:
The debuff from this talent can now be caused by Backstab in addition to Ambush and can be triggered by all hits from these abilities rather than just critical strikes, but the snare component is now 50%, down from 70%.
With that information, I think it's safe to say that wound/wound or wound/mind is likely going to be your best bet. Deadly poison doesn't tend to shine unless you're specced for it, while at the same time it DOES prevent you from making good use of Gouge and Blind on your current target. Since you will be using Rupture, you don't need the DoT itself to prevent rogues from restealthing, so I'd say it's almost always better to do wound/wound with a mind swap on another dagger.
Also, I'd be cautious of saying subtlety is better than assassination here, the cookie-cutter rogues will tear you apart. Subtlety will definitely get a bonus in the upcoming patch(es), but it's not known if it will break even with Mutilate/Envenom, rather less surpass it.
It'll still be more fun to play, though. ;)

I would definitely take Blood Spatter over Ruthlessness. Rupture is a necessity and should usually be your first opener in a BG situation after Kidney Shot, and should be part of your core playstyle in arena. I play a mutilate/eviscerate build which suffers many of the problems that a subtlety build will face - too much damage mitigated by plate. Rupture is definitely core.
I also dropped 1 point from Master of Subtlety in favor of maxing out HAT. HAT is incredibly awesome, however in many BGs it won't work to it's full potential without 3/3, because even though you could have 4 people around you critting all the time - how often is your entire party always in the same spot (or 50yards or so)? I think the combo point generation is going to help a lot more than 3% damage for 10 seconds a few times a minute (provided you even get to restealth that often).
I switched the Eviscerate glyph for the Gouge glyph, and also put one point from assination into improved Gouge. Improved/Glyphed Gouge is a great tool as you can use it to regain energy for free (when Rupture isn't up) by simply Gouging and waiting it out, as well as use it to help better control crowds in a stick situation - blow the CPs on your current target, Gouge the guy next to him, then continue beating the target you were on. Also handy for interrupting a node capper while you deal with his teammate, avoiding a bad situation while running a flag, and so forth. I'd suggest pulling more points from Sub to get 3/3, but that's up to you. ;)
