YES!
for every point over hit cap you are wasting an enchant or gem that can increase your dps. But all your hit is coming from gear, so unless you swap put pieces like your neck and one of your rings for non-hit items, your stuck.
Wowheads gear comparison does show edge of ruin higher but only by a small margin. If your doing hardmodes, the extra stam from Anquish is a good idea.

Yes, it is a bit of a DPS loss if you're gemming/enchanting, because as sunwu said - you could have used that gem/enchant for a stat that would have given a much higher DPS increase (ie: more Strength).
No, to a point. In your case, you're overcapped for hit mostly through gear. I assume that's just the gear that's dropped for you/that you've won, so not much of a choice there. However, being overcapped has the "advantage" of allowing greater flexibility for future upgrades. Nothing sucks more than getting something pretty, and not being able to use it because switching pieces would drop you way under hitcap. You shouldn't aim to purposely overcap just so you can upgrade to something shinier at a later date, but you work with what you're given and if you end up massively over-capped, not much you can do about it.
Side note: Yes hitcap is 263, but if you're part of a stable raiding guild and you're guarenteed some form of Draenei present, you can afford to drop down to 230 hit (7%) since they have their 1% hit aura (Heroic Presence) which would bring you up to 8%.
As for your weapon question: I think it's a bit of a wash. Edge of Ruin's stats are "better suited" to a Death Knight, but it's really hard to ignore the difference in top-end damage on Anguish and what that will do for your Strikes' damage. I would personally go for Anguish, but I think you could choose either and it wouldn't make an appreciable difference either way.

263 is not the cap, for melee hits yes but us Death Knights have many spells in our arsenal.
